John’s experience has spanned much of the world of securities and market regulation.

His current practice focuses on representing SEC, CFTC, IRS and qui tam whistleblowers, achieving extraordinary success for his clients. He has been involved in representing clients who have obtained millions of dollars from various whistleblower programs. Over the last fifteen years, he has represented plaintiffs in whistleblower, securities fraud, derivative, consumer, and other complex business litigation. Before that, John represented companies in complex transactional and SEC matters including firm and in-house positions. He has the experience of being “in the room,” drafting securities disclosure, and understanding the dynamics driving companies.

Mr. Sutter’s whistleblower matters include the following:

  • Counsel to whistleblowers who investigated and reported a massive $300 million Ponzi scheme peddling phony litigation settlements which resulted in civil and criminal charges by the SEC and DoJ and an ongoing receivership which has so far recovered close to $100 million.
  • Representing whistleblowers who uncovered an entirely fictional publicly traded company with a market cap in excess of $1 billion resulting in ongoing SEC and DoJ action against the company and its founder.
  • Counsel to whistleblowers who tipped off the SEC and other federal authorities to an alleged Ponzi-like fraud occurring at $1 billion hedge fund, ultimately leading to federal civil and criminal charges against the fund and its principals, with investor recoveries to date approaching $100 million;
  • Providing analysis and support for counsel weighing strategic alternatives in the whistleblower process and counselling litigation funders on potential risks and evaluations in connection with extending funding to whistleblowers.
  • Representing external and internal insiders in several cases regarding multi-million-dollar frauds by manufacturers of electric, fuel cell and other green vehicles.
  • Counsel to several groups of whistleblowers including current and former employees as well as victims who have reported significant ongoing fraudulent schemes in the digital asset space.
  • Representation of an individual who has prompted SEC and CFTC investigations into a series of unregistered offshore exchanges.
  • Working with whistleblower groups focused on issuer obligations related to SPAC transactions.
  • Counsel to various whistleblowers bringing claims related to violations of the Investment Company Act of 1940.

Mr. Sutter is a member of the bars of Massachusetts, the Massachusetts Federal District Court and the First Circuit Court of Appeals. He is a summa cum laude graduate of Boston University School of Law, recipient of the Berger Award for Academic Excellence, member of the Boston University Law review, and a charter member of the Phi Delta Phi academic organization at B.U.S.L.
